Tips for building your wrongful termination case

Suddenly losing your job can be a shock, to say the least. It can leave you reeling, not knowing what your next steps should be. If you’re in that situation now, then you’re probably rightfully worried about your financial stability and the harm that has been caused to your career. You can be just as concerned if you still have your job but suspect that termination is imminent.

But as your try to find a path forward, you should carefully assess the circumstances surrounding your situation to determine if you were or will be subjected to a wrongful termination. If so, then legal action is warranted.

Building your wrongful termination case

Even if you still have your job and suspect that you’ll be let go any day now, there are steps that you can take to protect yourself in the event of a wrongful termination. Amongst them are the following:

  • Keep all communications: Once you’re let go from your position, you’ll be locked out of your company email and you won’t be able to retrieve any communications that you had there. So, if your supervisor indicated your performance was poor as a precursor to your termination, then keep those records as well as all of your performance appraisals that show otherwise. Also keep documents that are indicative of discrimination or harassment.
  • Keep your cool: It can be easy to get angry when you’re being disciplined, reprimanded, or fired. But your statements will be used against you in a wrongful termination case. So, try to keep your emotions in check, be polite, and remember that you don’t want to give your employer any justification for letting you go.
  • Gather other facts: Talk to other witnesses and gather any other evidence that show relevant facts. Sudden changes to your work schedule, exclusion from meetings, evidence that you reported wrongdoing, and witness accounts of improper treatment in the workplace can all strongly support your case.
