Mother says doctor errors killed her son

In Nov. 2012, a man suffered an injury at work that required surgery and a cast to be put on his leg. By Dec. 18, 2012, he was dead, and his mother blames doctor errors. As many Oregon residents would do in her place, she filed a medical malpractice claim against the doctor in 2014.

Court records indicate that the woman’s son tore a tendon in his knee in the work accident, and it required surgery to repair. On Dec. 17, 2012, the man went to see his doctor in order to have the cast removed and replace it with a brace. Unfortunately, the brace was not ready, and the doctor gave the man the option of cutting the cast. That way, if he chose to do so, the man could remove the cast at home and begin exercises to improve his range of motion.

His mother further claims that the Colorado doctor failed to perform an examination of her son’s leg to be sure that everything was okay. The next morning, her son could not breathe. Sadly, he passed away. It turned out that he died from a blood clot that his mother asserts should have been found on Dec. 17, 2012.

She filed a medical malpractice claim based on what she perceives to be doctor errors. The doctor claims the man had a pre-existing condition that caused him to suffer from blood clots. As would be the case here in Oregon, it will be up to the court to determine whether sufficient proof exists that the doctor’s care was below accepted standards and led to the man’s death. If negligence is proved, the woman may be awarded damages, and the possibility of someone else being hurt in a similar manner may be avoided.
