Hospital negligence, doctor errors cited in recent lawsuit

Oregon residents go to the hospital to receive adequate medical treatment from a knowledgeable and experienced medical professional. A diagnosis is expected to be timely, and the treatment is expected to be sufficient in relieving pain and symptoms associated with the problem. Unfortunately, this does not always happen. In fact, it is a failure to diagnose in a timely manner that has resulted in a physician and a hospital being named as defendants in a doctor and hospital negligence lawsuit.

According to the lawsuit, the victim says he went to the emergency room on January 21 of last year due to extreme swelling and pain in his leg. At the hospital, a physician said that a Doppler study was needed of his right leg, but that it could not be performed for another three days. He was then prescribed a blood thinner, and his girlfriend was shown how to administer it. He was then sent home.

The following day, the man says that he was still in significant pain. He pleaded with his girlfriend to take him to a different hospital because of the poor care he received the day before. Once he arrived at the new hospital, it was determined by the physicians that there was a blood clot in the man’s leg. It was this that was causing his pain, and it required immediate surgery.

As a result of the initial physician failing to timely diagnose his condition, the man lost function in his right leg. He also continues to have pain and needs help maneuvering around his home. He is seeking various damages, including injury relief, medical expenses and punitive damages.

It is not uncommon for hospital negligence or a doctor’s errors to result in physical pain and suffering, emotional distress, injuries and even death in extreme cases. When this occurs here in Oregon, victims or the families of deceased victims may be able to use that data as a basis for a civil lawsuit. Once negligence is established and proven in court, victims or their families may receive financial compensation for the pain and suffering, lost wages, past and future medical-related expenses as well as any the damages the court sees fit.
