Understanding Legal Protections Against Discrimination In Oregon Workplaces
Under Oregon and federal law, employers may not make employment decisions – such as hiring, firing, promotions, or discipline – based on legally protected characteristics. These include:
- Race or color
- National origin
- Religion or religious affiliation
- Sex, gender, gender identity or sexual orientation
- Marital status
- Age (18 and older)
- Actual or perceived disability
- Veteran’s status or military service
These are the more common protected characteristics, but there are other protections under state and federal law. In addition, it is unlawful for employers to retaliate against workers who report discrimination or participate in investigations related to workplace misconduct. Such reports may qualify you for whistleblower protection.
What Workplace Discrimination Might Look Like
Discrimination at its core is treating someone differently than others because of a protected classification. Discriminatory behavior is often subtle and can be disguised as neutral decision-making. Examples that may indicate illegal discrimination include:
- Women being paid less than male colleagues for the same work
- Qualified employees of color being consistently overlooked for promotions
- A job offer being rescinded after an employer learns of a disability during an in-person interview
- Termination shortly after referencing a same-sex spouse or partner
If you’ve experienced or witnessed patterns like these, our employment attorneys can help assess whether your rights have been violated under the law.
